1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Montgo Labs S.L. ("we," "us" or "our"), concerning your access to and use of the PainterFlow AI web application as well as any other media form, media channel, mobile website or mobile application related thereto (collectively, the "Site").

By accessing the Site, you agree that you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using the Site and must discontinue use immediately.

2. Service Description and AI Limitations

PainterFlow AI provides a voice-to-quote tool intended to assist professional painting contractors in generating estimates based on spoken input.

• AI Parsing: The service uses artificial intelligence to interpret voice recordings and extract measurements, surfaces, and materials. While we strive for high accuracy, AI interpretations may contain errors.
• Verification Requirement: You are solely responsible for reviewing and verifying the accuracy of all generated line items, measurements, calculations, and final prices before submitting any quote or estimate to a client.
• No Guarantee: We make no warranties regarding the accuracy of the AI transcription or intent parsing. We are not liable for any financial losses or disputes arising from incorrect quotes generated through our system.

3. User Accounts & Responsibilities

When creating an account, you agree to provide true, accurate, current, and complete information. You are responsible for keeping your password confidential and will be responsible for all use of your account and password.

You may not use the Site for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws. You must ensure that you have obtained the necessary consent from any third parties (such as your clients) before inputting their personal data (e.g., names, addresses) into PainterFlow AI.

4. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

5. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site, even if we have been advised of the possibility of such damages.
